Whilst you may belong to the below groups that are not subject to immigration control, a right to work check is still required. In the event that your employer does not obtain an acceptable document, and are found to have employed an illegal worker, they will not have a statutory excuse against liability for a civil penalty.
The following categories of individuals are not subject to UK
- British citizens
- Commonwealth citizens and citizens of the UK and Colonies with the
right of abode in the UK
- Nationals from the Common Travel Area (Ireland, Isle of Man and the
- Nationals from European Economic Area (EEA) and Switzerland
- Non EEA family members of nationals from EEA countries and
Switzerland, if the EEA national is lawfully residing in the UK.
